Land Rights as Shares in a Mining Business License-Holding Company

Abstract

This study examines and further analyzes land ownership as shares in positive law in Indonesia.The research method used is normative legal research, namely legal research conducted by examining library or secondary legal materials.At the same time, the problem approach is carried out using the statutory and conceptual approaches.The study results indicate that the provisions of Article 34 of Law Number 40 of 2007 concerning Limited Liability Companies state that share capital deposits can be made in the form of money and other forms.Suppose the deposit is made in other forms.In that case, the capital deposit on shares is assessed based on the fair value determined by the market price or experts not affiliated with the company.
